PriceSeek provides AI-powered pricing analysis for clothing and fashion items through:

  • Integration with eBay, Shopify, and other marketplaces
  • Automated listing generation and optimization
  • Analytics and performance tracking

CRITICAL DISCLAIMER - PLEASE READ CAREFULLY

PriceSeek provides AI-powered analysis for informational purposes only. By using our Service, you explicitly acknowledge and agree that:

  • NO AUTHENTICITY VERIFICATION: We DO NOT and CANNOT verify the authenticity of items. We DO NOT detect counterfeit, fake, or replica items.
  • BEST-EFFORT ANALYSIS ONLY: All product identifications and pricing suggestions are estimates based on visual similarity and available data. These may be incorrect or inaccurate.
  • YOUR SOLE RESPONSIBILITY: You are 100% responsible for verifying item authenticity, accurate identification, and compliance with all laws before listing or selling any items.
  • NO RELIANCE: Our analysis should NEVER be your sole basis for business decisions. Always perform your own due diligence.
  • AI LIMITATIONS: Artificial intelligence can and does make errors. Misidentifications are possible and expected.

User Accounts

Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One account per person or business entity
  • Must be 18 years or older, or have parental consent

Account Responsibilities

  • Keep login credentials secure and confidential
  • Notify us immediately of unauthorized access
  • All activities under your account are your responsibility
  • Comply with all applicable laws and regulations

Acceptable Use

Permitted Uses

  • Analyze clothing and fashion items for resale purposes
  • Generate pricing recommendations for your own inventory
  • Create listings for items you own or have authorization to sell
  • Use analytics to improve your business performance

Prohibited Uses

  • Upload images of items you don't own or lack authorization to sell
  • Use the service for illegal or fraudulent activities
  • Knowingly sell counterfeit, fake, or stolen items
  • Rely on our service as authentication for genuine items
  • Misrepresent our analysis as professional authentication or appraisal
  • Attempt to reverse engineer, hack, or disrupt the service
  • Violate intellectual property rights of others
  • Upload inappropriate, offensive, or copyrighted content
  • Share account access with unauthorized users
  • Use automated tools to scrape or abuse the service

Subscription Plans & Billing

Free Plan

  • Limited monthly usage (specified in your account)
  • Basic features and support
  • No billing or payment required

Paid Plans

  • Monthly or annual billing cycles
  • Automatic recurring charges unless cancelled
  • Changes to pricing with 30 days notice
  • No refunds for partial month usage
  • Free trial periods as advertised

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds for unused portions of paid periods.

Intellectual Property

Our Rights

PriceSeek and all related technology, algorithms, and content are protected by intellectual property laws. We retain all rights to our service, including but not limited to:

  • AI models and pricing algorithms
  • Software code and architecture
  • Trademarks, logos, and branding
  • Service design and user interface

Your Rights

You retain ownership of content you upload, but grant us necessary rights to:

  • Process images for pricing analysis
  • Store data necessary to provide the service
  • Use aggregated, anonymized data to improve our AI models
  • Display your content back to you through our service

Service Availability & Accuracy

Service Uptime

We strive to maintain high availability but cannot guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect access.

NO WARRANTY OR GUARANTEE

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim all warranties regarding:

  • Accuracy of product identification or pricing suggestions
  • Authenticity verification or counterfeit detection
  • Merchantability or fitness for any particular purpose
  • Uninterrupted or error-free service operation
  • Security of data or communications
  • Results or outcomes from using our service

You acknowledge that pricing suggestions are estimates only. Market conditions change rapidly. You are solely responsible for all pricing decisions and their consequences. We are not liable for pricing accuracy, sales outcomes, or any losses resulting from reliance on our analysis.

Third-Party Integrations

PriceSeek integrates with third-party services (eBay, Shopify, etc.) subject to their terms and policies:

  • You must comply with all third-party platform policies
  • We are not responsible for third-party service changes or outages
  • Integration features may change based on third-party API availability
  • Your use of integrated platforms is subject to their separate terms

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRICESEEK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, sales, data, or business opportunities
  • Costs of procurement of substitute goods or services
  • Business interruption or service outages
  • Inaccurate product identification or pricing recommendations
  • Legal consequences from selling misidentified or counterfeit items
  • Claims by third parties related to items you list or sell
  • Failure to detect counterfeit, fake, or replica items
  • Any reliance on our analysis or recommendations
  • Actions taken based on our service output

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless PriceSeek, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with:

  • Your use or misuse of the Service
  • Your listing or sale of items based on our analysis
  • Any claim that items you sold were counterfeit, fake, stolen, or misrepresented
  • Your violation of these Terms or any applicable laws
  • Your violation of any third-party rights
  • Content you upload, submit, or transmit through the Service
  • Your business activities, decisions, and their consequences
  • Any claim related to product authenticity or identification accuracy

This indemnification obligation will survive the termination of these Terms and your use of the Service.

Termination

By You

You may terminate your account at any time by:

  • Cancelling your subscription through account settings
  • Contacting our support team
  • Ceasing to use the service

By Us

We may suspend or terminate your account for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Abuse of the service or other users
  • Extended inactivity (free accounts)

Effect of Termination

Upon termination:

  • Your access to the service ends immediately
  • We may delete your account data after reasonable notice
  • You remain liable for all charges incurred
  • Surviving provisions of these Terms remain in effect

Changes to Terms

Continued use of PriceSeek after changes constitutes acceptance of the updated Terms.

  • All analysis is PROVIDED "AS IS" without any warranty
  • You are SOLELY RESPONSIBLE for verifying authenticity before selling
  • You WILL NOT hold us liable for misidentifications or their consequences
  • You MUST perform your own due diligence on all items
